Article 91 of the Penal Code states that after a medical evaluation establishing criminal irresponsibility, the person may be compulsorily interned following court decision “whenever by reason of psychic anomaly and the severity of the fact committed, there is well-founded fear that it will commit other acts of the same kind”.
Looks like the 'psychic anomaly' there might be intended to refer to someone who is under age:
Children under 16 years are not criminally liable, nor are those who, due to psychic anomaly, at the time of committing the act, were unable to assess the lawfulness of such act or to conform themselves in accordance with such assessment.
